The following General Terms and Conditions (GTC) also contain legal information on your rights under the regulations on contracts in distance selling and electronic commerce.
 
1. Scope of application

- hereinafter referred to as "Seller" - and the customer designated in § 2 of the contract - hereinafter referred to as "Customer" - the following General Terms and Conditions shall apply exclusively in the version valid at the time of the order. Deviating terms and conditions of the Customer shall not be recognised unless the Seller expressly agrees to their validity in writing.

3. Offer and conclusion of contract

a.  The website www.creepyarts.com does not offer a direct order or shopping cart function. To order one or more items, you must send an e-mail to hello@creepy-images.com.

You will then receive a reply (usually within three days) regarding availability and the shipping and payment options available.

b. The presentation of the products does not constitute a legally binding offer, but an invitation to place an order by the customer. All offers are valid while stocks last, unless the products are marked otherwise. In all other respects, errors are reserved despite the greatest possible care.
c. The contract is only concluded by delivery of the goods or by sending a separate order confirmation from the seller by e-mail within five days. Should you wish to collect the goods in person, the seller will suggest a date.

4. prices
a.  As a small entrepreneur within the meaning of §19 para. 1 of the German Value Added Tax Act (UStG), no value added tax shall be charged.
b. For delivery addresses within the Federal Republic of Germany, the European Union as well as worldwide shipping addresses, the shipping costs listed below apply.

5. Delivery, shipping costs and availability of goods

a. Please refer to the following list for delivery times and shipping costs for your delivery address: Delivery and shipping costs

We will indicate any deviating delivery times on the respective product page.

b. The goods will not be dispatched until payment has been received.
c. If the ordered product cannot be delivered in time because the seller is not supplied with this product by his suppliers in time, the seller will inform you immediately. In such a case, you are free to wait for the ordered product or to cancel your order. In the event of cancellation, any payments already made will be refunded immediately.

 
6. Payment
a. In case of payment in advance, please direct the payment to the bank details provided to you by e-mail.
b. When sending the order, the seller will take over the entire payment processing. This is a service provided by the seller. In this case, the payments of all refunds, as well as other refunds initiated by the seller, will also be made by the seller.

In addition, the following payment options are available to you via the internet payment system PayPal:

• Bank transfer
• Giropay

The PayPal terms of use apply. PayPal debits your account when paying by direct debit or credit card within 3 days after completion of the order.

c. After receipt of your payment, you will immediately receive a payment confirmation by e-mail.
 
7. Retention of titleThe delivered goods remain the property of the seller until full payment has been made.

8. Warranty
The seller shall be liable for material defects in accordance with the statutory provisions applicable in this respect.
 
9. Liability
a. The Seller shall be liable without limitation in accordance with the statutory provisions for damage to life, limb and health caused by a negligent or intentional breach of duty by the Seller, its legal representatives or its vicarious agents, as well as for damage covered by liability under the Product Liability Act.
b. For damages not covered by a) and which are based on intentional or grossly negligent breaches of contract or fraudulent intent on the part of the Seller, its legal representatives or its vicarious agents, the Seller shall be liable in accordance with the statutory provisions.
c. The Seller shall also be liable for damage caused by simple negligence insofar as the negligence relates to the breach of such contractual obligations, compliance with which is of particular importance for the achievement of the purpose of the contract (essential contractual obligations). In the event of a breach of material contractual obligations, the Seller shall only be liable for the foreseeable damage typical for the contract if such damage was caused by negligence, unless it is a claim for damages arising from injury to life, body or health.
d. Any further liability is excluded regardless of the legal nature of the asserted claim; this also applies in particular to tortious claims or claims for reimbursement of futile expenses instead of performance.
e. Insofar as the Seller's liability is excluded or limited, this shall also apply to the personal liability of its employees, workers, staff, representatives and vicarious agents.

11. Final provisions
a. This contract including the form of its conclusion and all rights and obligations arising from it are subject to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
b. Should individual provisions of this contract be invalid, the rest of the contract shall remain valid.
